1. Acceptance of Terms
Welcome to JobShield. By accessing or using JobShield ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is operated by JobShield ("Company," "we," "us," or "our").
2. Description of Service
JobShield provides a platform that allows users to:
- Upload and organize project photos
- Document job progress
- Maintain project records
- Collaborate with authorized team members
- Store project-related notes and documentation
JobShield is a documentation and record-management platform. JobShield does not provide legal, engineering, architectural, construction, accounting, or professional advice.
3. User Accounts
You must provide accurate information when creating an account. You are responsible for:
- Maintaining account security
- Protecting your password
- Activities occurring under your account
You must immediately notify us of any unauthorized use of your account.
4. User Content
Users retain ownership of content they upload to JobShield. By uploading content, you grant JobShield a non-exclusive, worldwide license to store, process, display, transmit, and back up the content solely for operating and improving the Service.
You represent that:
- You own or have permission to upload the content.
- The content does not violate any law or third-party rights.
- The content does not infringe copyrights, trademarks, or privacy rights.
5. Prohibited Uses
You may not:
- Upload unlawful content
- Upload malicious software
- Attempt unauthorized access to systems
- Interfere with platform operation
- Use the Service for fraudulent purposes
- Violate applicable laws
We may suspend or terminate accounts that violate these Terms.
6. Subscription and Billing
Certain features may require a paid subscription. By purchasing a subscription, you authorize recurring billing until canceled. Subscription fees are non-refundable except where required by law. Users may cancel subscriptions at any time through their account settings.
7. Data Storage and Availability
We strive to maintain reliable service availability but do not guarantee uninterrupted access. Users are responsible for maintaining independent backups of critical records and documentation.
8. Intellectual Property
The Service, software, branding, logos, designs, and related intellectual property are owned by JobShield and protected by applicable laws. Users may not copy, reverse engineer, or redistribute the Service without written permission.
9. Termination
We may suspend or terminate access for violations of these Terms or for any reason permitted by law. Upon termination, access to stored content may be restricted or removed according to our retention policies.
10. Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, JobShield disclaims all warranties, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Continuous availability
- Accuracy of user-generated content

12. Governing Law
These Terms shall be governed by the laws of the State of Iowa, without regard to conflict-of-law principles.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: JOBSHIELD, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF PROFITS
- LOSS OF BUSINESS OPPORTUNITIES
- LOSS OF DATA
- LOSS OF GOODWILL
- PROJECT DELAYS
- CONTRACT DISPUTES
- CUSTOMER DISPUTES
- LEGAL CLAIMS ARISING FROM USER CONTENT
JOBSHIELD DOES NOT GUARANTEE THAT PHOTOS, RECORDS, OR DOCUMENTATION STORED THROUGH THE SERVICE WILL BE ADMISSIBLE IN COURT, SUFFICIENT TO RESOLVE DISPUTES, OR ACCEPTED AS EVIDENCE BY ANY THIRD PARTY.
JOBSHIELD'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY THE USER TO JOBSHIELD DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100).
USERS ACKNOWLEDGE THAT THEY ARE RESPONSIBLE FOR MAINTAINING INDEPENDENT COPIES OF CRITICAL PROJECT RECORDS AND DOCUMENTATION.
